Court Mandates EFCC to Compensate Pastor and Wife with N10 Million for Unlawful Declaration, Demands Public Apology

Background of the Case:

The case was brought before Justice Dashen, who presided over the matter. Pastor Biribena, the leader of the Christ Embassy Church in Kumasi, Ghana, was the aggrieved party in this legal battle. The EFCC had declared both him and his wife wanted on June 8, 2022, without legal authorization.

Court’s Ruling:

Justice Dashen’s verdict deemed the EFCC’s actions illegal, unconstitutional, and unjustifiable. Consequently, the court mandated the EFCC to issue a public apology to Pastor Biribena and his spouse for the unwarranted declaration.

Legal Consequences:

The Federal High Court in Yenagoa, Bayelsa State, delivered a significant blow to the EFCC by imposing a fine of N10 million for its erroneous actions. Despite the plaintiffs initially seeking ₦100 million in damages, the court deemed N10 million as sufficient exemplary damages against the EFCC.

This ruling not only highlights the importance of due process but also serves as a reminder of the consequences of overstepping legal boundaries, even for law enforcement agencies.
